Actibux is committed to protecting the privacy, safety and wellbeing of children and families who use the platform.

Actibux is designed using privacy-by-design and child-safety principles and seeks to implement safeguards intended to support compliance with applicable data protection and child privacy laws, including:

  • EU GDPR
  • UK Data Protection Act 2018
  • COPPA (where applicable)
  • Applicable consumer protection legislation
  • Apple App Store requirements
  • Google Play Store requirements

Actibux continually reviews its policies, procedures and technical controls to support ongoing compliance with applicable legal and regulatory requirements.

Nothing in these Terms shall be interpreted as a representation or warranty that Actibux is compliant with every law or regulation in every jurisdiction at all times.

Users remain responsible for complying with local laws applicable to their use of the Services.

Privacy By Design

Actibux has been designed to minimise the collection of personal information and provide parents with meaningful oversight and control of child participation.

This includes:

  • Parent-controlled account creation
  • Parent approval of rewards
  • Parent access to child information
  • Parent rights to request deletion of information
  • Limited collection of child data
  • No sale of children’s personal information
  • No targeted advertising using children’s personal information
  • Security measures designed to protect personal information

Child Safety Commitment

Actibux is intended to provide a safe, parent-controlled environment that encourages healthy activity and positive behaviour.

Actibux does not currently provide:

  • Public social networking
  • Child-to-child messaging
  • Public chat
  • User forums
  • Public content sharing

Parents remain responsible for supervising their child’s use of the platform and determining whether activities and rewards are suitable.

Health Data Commitment

Where authorised by a parent, Actibux may access activity information from:

  • Apple Health
  • Google Health Connect
  • Approved wearable integrations

Such information is used solely for:

  • Measuring activity
  • Awarding points
  • Operating rewards
  • Maintaining platform functionality

Health information is not sold.

Health information is not used for targeted advertising.

Continuous Improvement

Actibux reserves the right to modify its policies, procedures, security controls and compliance measures to reflect:

  • Changes in law
  • Regulatory guidance
  • Platform developments
  • Industry best practices
  • Child safety requirements

6. Electronic Acceptance

By creating an account, clicking “Accept”, purchasing a subscription or otherwise using Actibux, the Parent enters into a legally binding agreement with Actibux.

7. Parent Responsibilities

Parents are solely responsible for:

  • Child participation
  • Device access
  • Account security
  • Password security
  • Reward approvals
  • Assessing activity suitability

Parents must ensure that information provided is accurate and up to date.

8. Account Security

Parents are responsible for maintaining the confidentiality of account credentials and all activity conducted through their accounts.

9. Activity Tracking

Actibux may receive activity information from:

  • Apple Health
  • Google Health Connect
  • Approved wearable providers

Activity information is supplied by third-party systems and may not always be accurate.

Actibux does not guarantee activity calculations, step counts, points allocations or reward outcomes.

10. Rewards Programme

Rewards may include:

  • Robux gift cards
  • Digital rewards
  • Gift cards
  • Promotional rewards
  • Other rewards offered from time to time

Rewards:

  • Have no cash value unless required by law
  • Are not transferable
  • May be amended or withdrawn
  • Are subject to availability

11. Future Features

Actibux may introduce new features, integrations, services, reward types and platform functionality from time to time.

Additional terms may apply to future services.

12. Payments

Payments may be processed through:

  • Stripe

Third-party payment providers may apply their own terms and conditions.

13. Chargebacks

Actibux reserves the right to suspend accounts where payment disputes, chargebacks or fraudulent payment activity occur.

14. Fraud & Abuse

Acting reasonably and in good faith, Actibux may investigate suspected:

  • Step spoofing
  • Device manipulation
  • Artificial activity generation
  • Fraudulent reward redemption
  • Abuse of promotions

Where abuse is suspected Actibux may:

  • Remove points
  • Reverse rewards
  • Suspend accounts
  • Terminate accounts

15. Reward Supplier Disclaimer

Third-party reward providers remain responsible for their own products, services, availability and redemption processes.

Actibux is not responsible for failures, delays, changes or interruptions caused by reward suppliers.

16. Roblox Disclaimer

Actibux is not affiliated with, endorsed by, sponsored by or administered by Roblox Corporation.

All Roblox trademarks remain the property of their respective owners.

17. Medical Disclaimer

Actibux:

  • Is not a medical device
  • Is not a healthcare provider
  • Does not provide medical advice
  • Does not provide fitness instruction

Parents should seek professional advice regarding any health concerns.

18. Intellectual Property

All rights relating to:

  • Actibux
  • Branding
  • Software
  • Algorithms
  • Technology
  • Reward systems
  • Gamification systems

remain the exclusive property of Actibux.

19. Service Availability

Actibux does not guarantee uninterrupted operation or availability of the platform.

20. Force Majeure

Actibux shall not be liable for delays or failures resulting from circumstances beyond its reasonable control including:

  • Cloud outages
  • Cyber attacks
  • Internet failures
  • Government action
  • Natural disasters
  • Third-party service interruptions

21. Business Transfers

In the event of a merger, acquisition, restructuring or sale of assets, user information may be transferred as part of the transaction subject to applicable law.

22. Limitation of Liability

To the fullest extent permitted by law:

Actibux shall not be liable for:

  • Indirect losses
  • Consequential losses
  • Lost profits
  • Lost opportunities
  • Data loss
  • Third-party service failures

Actibux’s total liability shall not exceed the greater of:

  • £100
  • The amount paid by the Parent during the previous twelve months

23. International Use

Users are responsible for compliance with local laws applicable to their use of the platform.

Actibux may restrict access to certain countries or territories.

24. Export Controls & Sanctions

Users must comply with applicable export control and sanctions laws.

25. Dispute Resolution

For UK users

The courts of England and Wales shall have jurisdiction.

For US users

  • Informal dispute resolution should be attempted first.
  • Claims must be brought individually.
  • Class actions are waived to the extent permitted by law.

26. Termination

Actibux may suspend or terminate accounts for breaches of these Terms.

Parents may close accounts at any time.

27. Changes To These Terms

Actibux may update these Terms from time to time.

Material changes will be notified through the platform, website or email where appropriate.
